2010/32/UE EUROPEAN DIRECTIVE OF THE COUNCIL OF 10 MAY 2010 ON THE PREVENTION OF INJURY

Dated June 21, 2010 came into force 2010/32/UE Council Directive of 10 May 2010 implementing the Framework Agreement for the prevention of injury from sharps in the hospital sector and health.

This Directive obliges Member States of the Union to enact the laws, regulations and administrative provisions necessary to comply with the provisions thereof and all that, no later than May 11, 2013.

Directive, is fully applicable to the sector of Odonto-Stomatology and this can be seen in the definitions contained in Clause 3 of the Agreement. Workplaces are defined as "Organizations / health care public and private sectors, and any other place where made and provide services / health activities under the direction and supervision of the employer." On the other hand, means employers: "The individuals / legal entities which have an employment relationship with workers. They are responsible for the management, organization and delivery of health care and related activities and services directly incurred by the workers. " Ultimately define medical sharps as "objects or instruments necessary for the exercise of specific activities health care and related activities and services directly incurred by the workers. "

On the other hand, this Directive constitutes a fundamental instrument for the prevention of injury from sharps and harmonize the laws in prevention of these lesions in all Member States of the European Union. Similarly, will harmonize the various provisions enacted on the subject by certain autonomous communities with competence.

Another major feature of the Directive is left to the Member States of the Union's characterization of penalties applicable to infringements of the provisions thereof, provided, about the community standard that those penalties must be effective, proportionate and dissuasive. In this way, is to avoid that compensation is more economical than the costs to comply with the provisions thereof by the obligors.

In conclusion we must say that this directive is an important step in protecting the health of health professionals, step it, if you will, initially, but that when establishing the most favorable terms from the state and Autonomous Communities, will reach at least momentarily, the maximum ideal hedge against these risks.
